Our prices include car rental and standard car rental insurance. - Yazdır Rental Period
The rental is at least 1 day (24 hours). For shorter rentals, daily price is applied. In case of delay, 1/3 of the applied fee is charged for each additional hour, and if the delay exceeds 3 hours, full-time fee is collected. İşbu sözleşme, www.enterprise.com.tr adresinde faaliyet gösteren sitenin tüm haklarının sahibi olan, TEM Otoyolu Kavacık Kavşağı Ford Plaza Kat:4 Rüzgarlıbahçe Beykoz İstanbul adresinde bulunan Yes Oto Kiralama ve Turizm Yatırımları A.Ş. ile siteye üye olan Üye arasında, üyenin www.enterprise.com.tr alan adlı internet sitesi üzerinden kendi iradesiyle yaptığı üye kaydı aşamasında yapılmıştır. Üye, siteye üye olarak, işbu sözleşmenin tamamını okuduğunu, anladığını ve tüm hükümlerini onayladığını kabul, beyan ve taahhüt eder.

İşbu sözleşmede belirtilen;
Enterprise Türkiye: Yes Oto Kiralama ve Turizm Yatırımları A.Ş.’yi,
Üye: Siteye üye olan gerçek veya tüzel kişiyi,
Site: www.enterprise.com.tr adlı alan adı üzerinde faaliyet gösteren internet sitesini,
Araç: Mülkiyeti Enterprise Türkiye’ye ait ve kiralamaya konu edilen her marka ve modelde aracı,
Sözleşme: İşbu ‘İnternet Sitesi Üyelik Sözleşmesi’ni, ifade eder.
3. SÖZLEŞMENİN KONUSU VE AMACI
3.1. İşbu sözleşmenin konusu, araçların Enterprise Türkiye tarafından sitede online olarak internet üzerinden kiralanmaya sunulmasına dair usul ve esaslar ile Enterprise Türkiye ve Üye’nin karşılıklı hak ve yükümlülüklerinin belirlenmesidir. İşbu sözleşme, site üzerinden yapacağı tüm kiralamaları bakımından hüküm ifade eder.
3.2. İşbu sözleşmenin amacı siteye üye olan kişilerin Enterprise Türkiye tarafından belirlenen ek kampanya ve indirimlerden haberdar olmasını ve bunların yanı sıra her daim site üzerinden indirimli araç kiralayabilmesinin sağlanmasıdır.
4. Enterprise TÜRKİYE’NİN HAK VE YÜKÜMLÜLÜKLERİ
4.1. Enterprise Türkiye, kontrol ve denetimi altındaki kişisel kimlik, adres, iletişim bilgilerinin kaybolmasını, suistimal edilmesini ve değiştirilmesini engellemek amacıyla makul güvenlik önlemleri almaktadır. Ancak Enterprise Türkiye, bu bilgilerinin güvenliğini hiçbir şekilde garanti etmez. Üye’nin siteye aktardığı bilgi ve veriler gizli bilgi şeklinde yorumlanmayacaktır. KVKK ve sair ilgili mevzuattan doğan yükümlülükler saklıdır.
4.2. Enterprise Türkiye güvenlik nedeniyle Üye’nin site üzerindeki her türlü aktivitesini izleyebilir, kayda alabilir ve gerekli gördüğünde, siteden uzaklaştırma, üyelik dondurma, üyelik iptal etme ve benzeri her türlü müdahalede bulunabilir.
4.3. Enterprise Türkiye önceden Üye’ye bildirimde bulunmaksızın sitenin biçim ve içeriğini kısmen veya tamamen değiştirebileceği gibi, sitenin yayın yaptığı alan adını değiştirebilir, farklı alt alan adları kullanabilir, alan adı yönlendirmesi yapabilir ve/veya alan adını kapatabilir.
4.4. Enterprise Türkiye dilediği zamanda ve sebep göstermeksizin, önceden Üye’ye bilgi vermeksizin sitede sunduğu hizmetlerin kapsam ve çeşitlerini değiştirebileceği gibi, sitede sunulan hizmetleri kısmen veya tamamen dondurabilir, sona erdirebilir veya tamamen iptal edebilir.
4.5. Enterprise Türkiye, sözleşmede belirtilen iş ve işlemlerin daha etkin gerçekleştirilebilmesi açısından dilediği zaman hizmet, kiralama şartları ve işleyişte değişiklikler ve/veya güncellemeler yapabilir. Üyeler işbu değişiklikleri kabul ettiklerini, bu değişikliklere uygun davranacaklarını kabul ve beyan ederler.
4.6. İşbu sözleşme Enterprise Türkiye’nin kiralama yapacağı araç adedi, marka, model ve model yılı ve sair hususlarda herhangi bir taahhüt içermez. Üye, bu ve sair nedenlerle Enterprise Türkiye’den hiçbir ad altında hak ve alacak talep edemez.
4.7. Enterprise Türkiye’nin, kiralama faaliyetlerini tek taraflı olarak başlatmama, durdurma, sona erdirme ve/veya iptal etme hakkı mevcuttur. Üye bu hususta herhangi bir itiraz hakkının mevcut olmadığını kabul, beyan ve taahhüt eder.
5. ÜYE’NİN HAK VE YÜKÜMLÜLÜKLERİ
5.1. Üyelik, sitede belirtilen üyelik prosedürünün üye olmak isteyen kişi tarafından yerine
getirilerek kayıt işleminin yapılması ile tamamlanır. Üye, üye olmakla, işbu sözleşme
hükümlerini, üyeliğe ve hizmetlere ilişkin Enterprise Türkiye tarafından
açıklanan/açıklanacak her türlü beyanı da kabul etmiş sayılır.
5.2. Enterprise Türkiye tarafından site üzerinden verilen hizmet, kullanıcının üye olup olmadığına bakılmaksızın herkese eşit olarak verilmektedir. Üye işbu sözleşmeyi imzalamakla, sitede verilen genel hizmetlere ek olarak site üzerinden yapacağı araç kiralamalarında ek indirim sahibi olmakta ve Enterprise Türkiye tarafından tanımlanan ek kampanya ve indirimlerden haberdar olmaktadır. Üye, işbu sözleşme uyarınca kendisine elektronik ticari ileti gönderilmesine izin vermesi gerektiğini bilmekte ve kabul etmektedir.
5.3. Üye, üyelik işlemlerinde belirtmiş olduğu kimlik, sürücü belgesi, adres ve iletişim bilgilerinin eksiksiz ve doğru olduğunu, bilgilerinde değişiklik olması halinde bu bilgileri derhal Enterprise Türkiye’ye ileteceğini, eksik, güncel olmayan ve/veya yanlış bilgi vermesi nedeniyle ortaya çıkabilecek her türlü hukuki uyuşmazlık ve zarardan sadece kendisinin sorumlu olacağını kabul ve beyan eder. Enterprise Türkiye’ye bu nedenle hiçbir sorumluluk izafe edilemez.
5.4. Üye, sitede belirtilen hizmetlerden faydalanırken T.C. yasalarına ve genel ahlak kurallarına uygun hareket edeceğini, hakaret, tehdit, iftira, taciz ve benzeri eylemlerde bulunmayacağını, siyasi veya ideolojik propaganda yapmayacağını, diğer Üye'leri rahatsız edici davranışlar içine girmeyeceğini, kişi veya kurumları lekeleyici her türlü davranıştan uzak duracağını ve sitede verilen hizmetlerin aksamasına ya da kesilmesine neden olabilecek her türlü hareketten kaçınacağını aksi halde oluşacak her türlü zarardan bizzat sorumlu olacağını kabul ve taahhüt eder.
5.5. Üye, üçüncü şahısların fikri mülkiyet hukuku kapsamındaki haklarını ihlal etmeyeceğini, üçüncü kişilerin telif haklarına saygılı olacağını, haksız rekabette bulunmayacağını ve üçüncü şahısların ticari sırlarına ve özel hayatlarına saygılı olacağını kabul ve taahhüt eder.
5.6. Üye, siteyi kullanırken başkaları tarafından kolay tahmin edilemeyecek bir şifre kullanacağını, kullanıcı adı, şifre ve benzeri bilgilerini başkalarıyla paylaşmayacağını ve bu bilgilerin site veri tabanında tutulmadığından güvenliğinden bizzat ve sadece kendisinin sorumlu olacağını, hiçbir şekilde Enterprise Türkiye’nin sorumlu olmayacağını kabul ve beyan eder.
5.7. Üye, hileli davranışlarda bulunmayacağını, sitenin güvenlik mekanizmasına müdahale etmeyeceğini aksi halde oluşabilecek her türlü zarardan sorumlu olduğunu ve Enterprise Türkiye’nin uğrayacağı tüm zararları karşılayacağını taahhüt eder.
5.8. Üye, sadece kendisine ait üyelik hesabını kullanacağını, başka üyelerin hesap bilgilerini kullanmayacağını ve kendisine ait üyelik hesabını başkalarına kullandırtmayacağını, aksi durumun Enterprise Türkiye tarafından tespit edilmesi halinde üyeliğinin iptal edilebileceğini, yaptığı rezervasyonların iptal edilebileceğini, yaptığı kiralamaların sonlandırılabileceğini ve doğmuş/doğacal her türlü zararı tazmin edeceğini kabul ve beyan eder.
5.9. Üye, siteye, zararlı program, yazılım, kod ve benzeri materyal göndermeyeceğini, sitenin ve üyelerin güvenliğini tehlikeye düşürebilecek her türlü hareketten kaçınacağını kabul ve taahhüt eder.
5.10. Üye, üyelik hesabını üçüncü kişilere devredemez.
5.11. Üye, başkalarının siteyi kullanımını kısıtlayamaz, engel olamaz ve sitenin veya siteyi kullanılabilir hale getirmek için kullanılan sunucu veya ağların işletimine müdahale edemez.
5.12. Üyenin, bilgisayar donanımını etkileyen virüs saldırılarından ve/veya siteden edindiği bilgilere istinaden kaynaklanan kayıp ve hasarlar dâhil olmak üzere ancak bunlarla sınırlı olmamak kaydıyla siteye erişimine ve kullanımına ilişkin olarak doğrudan veya dolaylı olarak meydana gelebilecek zararlardan Enterprise Türkiye sorumlu değildir.
5.13. Üye, site çalışmasına müdahale etmek veya müdahaleye teşebbüs etmek amacıyla herhangi bir alet, yazılım veya araç kullanmayacağını, siteye yetkisiz olarak bağlanmayacağını ve işlem yapmayacağını, diğer internet kullanıcılarının yazılımlarına ve verilerine izinsiz olarak ulaşmayacağını veya bunları kullanmayacağını kabul eder.
5.14. Sitede, bu siteden tamamen bağımsız ve Enterprise Türkiye’nin kendi kontrolünde olmayan üçüncü kişilere ait başka internet sitelerine bağlantı sağlayan linkler bulunabilir. Enterprise Türkiye bu sitelerde bulunan bilgilerinin doğruluğu garanti etmez. Bu linkler vasıtasıyla erişilen internet sitelerinden sunulan hizmetler/ürünler veya bunların içeriği hakkında Enterprise Türkiye’nin herhangi bir sorumluluğu bulunmamaktadır. Üyenin bu internet sitelerine erişimi tamamen kendi sorumluluğunda ve Enterprise Türkiye’nin izni dışındadır.
5.15. Üye, işbu sözleşmeye ilişkin olarak yapacağı tüm işlemlerde, kendi üyelik kaydındaki bilgiler ile uyumlu kredi kartı kullanacağını, her ne şekilde olursa olsun başkasına ait kredi kartını kullanmayacağını, üyelik için başvurduğu isimle kredi kartında yer alan ismin aynı olacağını, kredi kartının kendisine ait olduğunu gayrikabili rücu kabul, beyan ve taahhüt eder. Bu hususa herhangi bir şekilde aykırı davranılması sebebiyle zarar doğması halinde, Üye, tüm sorumluluğun kendisine ait olduğunu, başkasına ait kredi kartı kullanmak sureti ile işlem yapılması halinde Enterprise Türkiye’den herhangi bir talepte bulunmayacağını, bu hususta Enterprise Türkiye’nin zarara uğraması halinde, Enterprise Türkiye’nin maruz kaldığı tüm doğrudan ve/veya dolaylı zararları karşılamakla yükümlü olduğunu gayrikabili rücu kabul, beyan ve taahhüt eder.
6. FİKRİ MÜLKİYET HAKLARI
6.1. Sitenin sunumu ve tüm içeriği T.C. Mevzuatı ve fikri mülkiyet mevzuatı tarafından korunmakta olup, bu sitedeki tüm ticari markalar, logolar ve hizmet işaretleri başta olmak üzere, yayınlanan tüm bilgi ve veriler Enterprise Türkiye veya lisans verenlere aittir. Üye, Enterprise Türkiye’nin yazılı onayı olmadan, doğrudan veya dolaylı olarak aynen ya da başka bir şekilde sitenin içeriğini dağıtamaz, iletemez, değiştiremez, kopyalayamaz, görüntüleyemez, çoğaltamaz, yayınlayamaz, işleyemez veya başka bir şekilde kullanamaz veya başkasının sitenin hizmetlerine erişmesine veya kullanmasına izin veremez. Aksi takdirde, Enterprise Türkiye’nin uğradığı/uğrayacağı her türlü zarar ile lisans verenler de dâhil ancak bunlarla sınırlı olmaksızın, üçüncü kişilerin uğradıkları zararlardan dolayı Enterprise Türkiye’den talep edilen her türlü tazminat tutarını, Üye Enterprise Türkiye’ye ödemekle sorumlu olacaktır.
6.2. Enterprise Türkiye’nin, Site hizmetleri, Site bilgileri, Site'nin telif haklarına tabi çalışmaları, Site'nin ticari markaları, Site'nin ticari görünümü veya Site'ye ilişkin her türlü maddi ve fikri mülkiyet hakları da dâhil tüm malvarlığı, ayni ve şahsi hakları, ticari bilgi ve know-how'a yönelik tüm hakları saklıdır.
6.3. Sitede yer alan bütün yazıların, grafiklerin, görsellerin ve tüm resimlerin her hakkı saklıdır, izinsiz tasarruf edilemez.
6.4. Site içeriğine, tasarımına ve yazılımına ilişkin tüm mali hakların izinsiz kullanımı (işleme, çoğaltma, yayma, temsil ve umuma arz) bunlarla sınırlı olmamak üzere her türlü izinsiz ifşa ve kullanım, fikri ve sınai mülkiyet haklarının ihlali anlamına gelecektir.
6.5. Üyeler Site'nin kullanımında Türk Borçlar Kanunu, Türk Ceza Kanunu, Fikir ve Sanat Eserleri Kanunu, Türk Ticaret Kanunu, Markalar Hakkında KHK ve mevcut ve/veya ileride yürürlüğe girecek olan her türlü mevzuat hükümlerine uygun davranacaklarını kabul ve taahhüt ederler. Aksi kullanım sebebiyle doğabilecek hukuki, idari, cezai ve mali her türlü sorumluluk Üye’ye ait olup Enterprise Türkiye’nin rücu hakkı saklıdır.
7. SORUMLULUK
Üye, Sitede sunulan/yayınlanan bilgi ve hizmetlerde eksiklik, iletişim sorunları, teknik problemler, altyapı ve internet arızaları, elektrik kesintisi ve/veya sayılanlarla sınırlı olmaksızın başkaca problemler olabileceğini kabul etmekte olup, bu tür problemler/arızalar oluşması durumunda Enterprise Türkiye Üye’ye herhangi bir bildirimde bulunmaya gerek olmaksızın ve sebep göstermeksizin sitede araç kiralama faaliyetlerini durdurmaya veya sona erdirmeye veya iptal etmeye yetkilidir. Üye bu nedenlerle Enterprise Türkiye’den hiçbir ad ve hesap altında hak ve ödeme talep edemez. Enterprise Türkiye hizmetin hatasız olacağını veya sürekli sağlanacağını veya hizmetin virüs ve diğer zararlı unsurlardan arınmış olduğunu garanti etmemektedir. Enterprise Türkiye üyenin herhangi bir ürün ya da hizmeti kullanmasından kaynaklanacak doğrudan ve/veya dolaylı hasarlardan sorumlu tutulamaz. Üye, hizmeti ya da siteyi kullanması sonucunda ortaya çıkabilecek her türlü hasar ve zarardan bizzat kendisinin sorumlu olduğunu kabul ve beyan eder.
8. MÜCBİR SEBEPLER
Doğal afet, isyan, savaş, grev, iletişim sorunları, teknik problemler, altyapı ve internet arızaları, elektrik kesintisi ve kötü hava koşulları da dâhil ve fakat bunlarla sınırlı olmamak kaydıyla, ilgili tarafın makul kontrolü haricinde ve gerekli özeni göstermesine rağmen önleyemediği, kaçınılamayacak haller olan "Mücbir Sebep" durumlarında; Enterprise Türkiye, işbu sözleşme ile belirlenen yükümlülüklerinden herhangi birini geç veya eksik ifa etme veya hiç ifa etmeme hakkına sahiptir. Zira işbu Mücbir Sebep süresince Enterprise Türkiye’nin yükümlülükleri askıya alınır. Bu ve bunun gibi durumlarda, Enterprise Türkiye’ye gecikme, eksik ifa etme veya ifa etmeme veya temerrüt addedilmeyecektir. Bu durumlar için Enterprise Türkiye’den her ne nam altında olursa olsun herhangi bir tazminat talep edilemeyecektir. Mücbir sebep halinde Enterprise Türkiye, dilerse işbu sözleşmeyi herhangi bir bildirime gerek olmaksızın tazminatsız ve tek taraflı olarak feshetmeye yetkilidir.
9. SÖZLEŞME HÜKÜMLERİNDE DEĞİŞİKLİK
Enterprise Türkiye, Üye’ye bildirimde bulunmaya gerek olmaksızın ve sebep göstermeksizin işbu sözleşme hükümlerinde tek taraflı olarak değişiklik yapma hakkına sahiptir. Üye, bahse konu değişiklikleri Site’de yayınlandığı andan itibaren kabul etmiş sayılır. Üye, bu hususu şimdiden gayri kabili rücu olarak kabul eder.
10. ÜYELİK İPTALİ VE SÖZLEŞMENİN FESHİ
10.1. Üye'nin işbu sözleşmeden kaynaklanan yükümlülüklerinden herhangi biri veya
tamamına kısmen veya tamamen aykırı davranması durumunda Enterprise Türkiye,
herhangi bir bildirime gerek olmaksızın ve gerekçe göstermeksizin tek taraflı olarak
işbu sözleşmeyi feshederek Üye'nin üyeliğini iptal edebilir ve Üye'nin siteden aldığı,
almakta olduğu ya da alacağı hizmetleri kısmen veya tamamen dondurulabilir veya iptal
edebilir. Bu nedenle fesih durumunda Üye Enterprise Türkiye’den hiçbir hak ve talepte
bulunamaz. Üye bu hususa itiraz edemez.
10.2. Enterprise Türkiye işbu sözleşmeyi dilediği takdirde hiçbir sebep göstermeksizin ve
herhangi bir bildirime gerek olmaksızın tek taraflı olarak feshederek Üye'nin üyeliğini
iptal etmeye ve Üye'nin siteden aldığı, almakta olduğu ya da alacağı hizmetleri kısmen
veya tamamen dondurmaya ya da tümüyle iptal etmeye yetkilidir. Bu takdirde Üye
haksız, yersiz, sebepsiz, meyilsiz ve zamansız bir fesihte bulunulduğu, iyi niyete aykırı
davranıldığı veya sair bir neden ve bahane öne sürerek Enterprise Türkiye’den hiçbir
hak, alacak, kar kaybı, zarar ziyan tazminatı veya başkaca bir nam ve unvan altında
herhangi bir ödeme talep edemez.
11. SÖZLEŞMENİN SÜRESİ
İşbu sözleşme Site’de onaylandığı andan itibaren yürürlüğe girer ve Enterprise Türkiye’nin
Üye’nin üyeliğini iptal etmesi ve/veya Site’de sunulan hizmetleri sona erdirmesi ile birlikte
başkaca bildirime gerek olmaksızın kendiliğinden sona erer.
12. GİZLİLİK
12.1. Üye, işbu Sözleşme’nin ifası tahtında Enterprise Türkiye ile ilgili olarak doğrudan veya dolaylı olarak edindiği, ticari, mali, hukuki veya teknik nitelikte, ticari sır ya da diğer yasal korumaya konu olan ya da olmayan her türlü bilgiyi gizli tutacak ve Enterprise Türkiye’nin izni olmaksızın herhangi bir kişiye ifşa etmeyecektir. Ancak, anılan gizlilik yükümlülüğü aşağıdaki hallerde geçerli olamayacaktır:
12.2. Enterprise Türkiye, kullanıcı profili ve pazar araştırmaları yapmak, satış ve site kullanım istatistikleri oluşturmak gibi amaçlar dâhil ancak bunlarla sınırlı olmamak üzere tüm yasal amaçlar için, Üye'nin kimlik, ehliyet, adres, iletişim, IP ve site kullanım bilgilerini bir veri tabanında toplayabilir ve bu bilgileri herhangi bir kısıtlama olmaksızın kullanabilir. Enterprise Türkiye, üyeye ilişkin bilgileri sitede sunulan hizmetler ile ilgili sigorta şirketi, banka ile ayrıca gerek gördüğü üçüncü kişi/kurumlarla paylaşmaya yetkilidir. Ayrıca Enterprise Türkiye bu bilgileri, yasaların getirdiği zorunluluklara uyma amacıyla veya yetkili adli veya idari otoritenin yürüttüğü soruşturma veya araştırma açısından talep edilmesi durumunda veya kullanıcıların hak ve güvenliklerinin korunması amacıyla üçüncü kişi/kurumlarla paylaşabilir.
13. TEBLİGAT
13.1. Taraflar, üyelik işlemleri esnasında belirttiği adreslerinin kanuni tebligat adresleri olduğunu, adres değişikliğinin diğer tarafa yazılı olarak bildirilmediği sürece bu adreslere yapılacak bildirimlerin kanunen geçerli tebligatın bütün hukuki sonuçlarını doğuracağını kabul ve taahhüt ederler.
13.2. Üye, sözleşme ve hizmetlerde yapılacak değişikliklerin, üyeliğin iptalinin, işbu sözleşmenin feshinin, sona erdirilmesinin vs. her türlü bildirimin üyelik işlemleri esnasına belirttiği e-posta adresine yapılmasına muvafakat etmiş olup, e-posta ile yapılan bildirimler ulaşsın veya ulaşmasın bildirimin Enterprise Türkiye tarafından gönderildiği andan itibaren tebliğ edilmiş olduğunu ve hukuki sonuçlarını doğuracağını kabul ve taahhüt eder. Bildirimin üyeye geç ulaşması veya ulaşmamasından ve sonuçlarından Enterprise Türkiye sorumlu değildir.
13.3. Üye’nin Enterprise Türkiye ile yapacağı yazışmalarda elektronik posta ve faks kullanılamaz.
14. YETKİ VE DELİL ANLAŞMASI
14.1. İşbu sözleşmenin uygulanmasından kaynaklanan sorunların çözümünde Türk Hukuku uygulanacak ve İstanbul Çağlayan (Merkez) Mahkemeleri ile İcra Daireleri yetkili olacaktır.
14.2. Üye, çıkabilecek ihtilaflarda, Enterprise Türkiye’nin her türlü belge, kayıt, defterleri ile
bilgisayar ve internet ortamındaki her türlü, bilgi, yazı ve kayıtlarının tek, münhasır ve
kesin delil teşkil edeceğini ve bağlayıcı olacağını, bu maddenin HMK.193 maddesi
kapsamında bir delil sözleşmesi olduğunu kabul eder.
15. MUHTELİF
15.1. İşbu Sözleşmenin herhangi bir hükmünün, herhangi bir nedenden dolayı geçersiz
sayılması veya uygulanabilirliğinin kalmaması halinde, sözleşmenin diğer hükümleri
yürürlükte kalacaktır.
15.2. Enterprise Türkiye’nin Sözleşme tahtında sahip olduğu herhangi bir hak veya yetkiyi
kullanmaması ya da kullanmakta gecikmesi o hak veya yetkiden feragat ettiği anlamına
gelmediği gibi, bir hak veya yetkinin tek başına veya kısmen kullanılması o veya başka
bir hak veya yetkinin daha sonra kullanılmasını engellemez. Bu Sözleşme’nin herhangi
bir koşul, madde veya hükmünden feragat edilmesi o koşul, madde veya hükümden
daha sonra veya devamlı olarak feragat edildiği anlamına gelmez veya bu şekilde
yorumlanamaz.
15.3. İşbu sözleşme Site’de onaylandığı andan itibaren, varsa daha önce Site’de onaylanan
sözleşmenin yerine geçer. İhtilaf halinde, hangi sözleşmenin yürürlükte olduğu
dönemden kaynaklandığına bakılmaksızın, bu sözleşme hükümleri uygulanır. Üye,
varsa daha önce Site’de onaylanan sözleşme ve ticari işleyişten dolayı Enterprise
Türkiye’den hiçbir hak ve alacağı olmadığını, Enterprise Türkiye’yi her türlü konuda en
geniş manada gayri kabili rücu olarak ibra ettiğini, bahse konu sözleşme ve ticari
ilişkiden dolayı Enterprise Türkiye’ye karşı doğmuş ve/veya doğacak tüm
sorumluluklarının devam ettiğini kabul, beyan ve taahhüt eder.
15.4. Üye, sitede yer alan tüm uygulama ve kuralları okuyup anladıklarını ve kabul ettiklerini
beyan ederler. Üye, sözleşmenin tamamında yer alan menfaatlerine aykırı olabilecek
düzenlemeleri de sonuçlarını bilerek ve anlayarak kabul ettiğini beyan eder.
15.5. Üye, işbu sözleşmeden kaynaklanan hak, alacak ve yükümlülüklerini öncesinde
Enterprise Türkiye’nin yazılı iznini almaksızın üçüncü kişilere devir veya temlik edemez.

As Yes Car Rental and tourism investments Inc (‘Company’) - acting as Data Officer, we would like to inform our valued customers within the framework of our clarification obligation as per the Personal Data Protection Law No. 6698 (“KVKK”) with this clarification text on the protection and processing of this personal data (“clarification text”).

Your personal data is collected in connection with your transactions with the company and for the purpose and scope set out in Section 4 below, by automatic or non-automatic means, oral, written and electronic means, and through the following methods and third parties with whom the company has an agreement.
- As a result of your rental transactions at Enterprise Turkey sales points, verbally or in writing,
- By means of visits, membership, registration and rental transactions that you have made through the company's websites,
- Sales made at contracted outlets where the company expert works, through company employees located here and information forms filled out ,
- Oral and written complaints made by customers to the global or Customer Contact Center through all sales points or social media and complaint platforms,
- Through customer relationship management programs (CRM) and other customer programs,
- Through the security cameras systems located at Enterprise Turkey sales points,
- Through third parties from whom the company purchases services in relation to its customers and with whom it is contracted for a business relationship.
The legal reasons stated in 5th and 6th articles of the KVKK regarding the processing of Personal Data are as follows:
- If your explicit consent is available,
- If it is explicitly prescribed in laws,
- If it is mandatory for the protection of his/her or someone else's life or body integrity for person who is unable to disclose his consent due to actual impossibility or whose consent is not granted legal validity,
- If personal data is processed in connection with the establishment or execution of a contract,
- If it is mandatory for the fulfillment of our legal obligations,
- If it is publicized by the person concerned,

- Within the scope of Ad/campaign/promotion processes and related communication activities, execution of the process of sending commercial electronic messages (campaign, advertising promotion, such as telephone, SMS, MMS, standard e-mail or in other ways) (identification and contact information, location information, customer transaction information, marketing information, vehicle information), (legal grounds: explicit consent)
- Conducting marketing processes and analysis of products and services (identification and contact information, location information, customer transaction, marketing information, vehicle information), (legal grounds: express consent)

- Execution of customer engagement processes including the membership via the website and sending a welcome e-mail pursuant to membership (identification and contact information, transaction safety information, marketing information), (legal grounds: explicit consent)

In addition, credit card and debit card information are processed (within the framework of security measures) for the purpose of completing payment transactions by our licensed partnet companies.

- Rights of the Owner of Personal Data under Article 11 of the KVKK
As the owner of personal data, in accordance with Article1 of the KVKK, you can request the following rights from the company acting as the data officer.
The rights you have in this context are as follows:
- Knowing whether personal data is processed,
- Requesting information if personal data has been processed,
- Knowing the purpose of processing personal data and whether it is used for its purpose,
- Knowledge of third parties -domectic or abroad- to whom personal data is transferred,
- Requesting correction of the personal data if it is incomplete or incorrectly processed and request that the transaction made in this framework be notified to the third parties to whom the personal data is transferred,
- Requesting deletion, destruction or anonymization of personal data within 30 (thirty) days, although it has been processed in accordance with the provisions of KVKK and other relevant laws, in case the reasons for processing disappear, and notification of related actions to third parties to whom personal data have been transferred, pursuant to the Regulations on the Deletion, Destruction or Anonymization of Personal Data,
- Disputing adverse consequences emerging from analysis of the processed data exclusively through automated systems,
- Requesting recovery of damages in case of damage due to unlawful processing of personal data.
The above-mentioned requests shall be forwarded to the company as data officer in writing or by other methods to be determined by the Personal Data Protection Board (‘Board’).
In this context, you may convey your requests related with above-mentioned rights via e-mail, which is given below and may change on occasion, from your registered electronic mail address, or your other email addresses bearing safe electronic signature or mobile signature, or through an email address that you have notified to the Company and registered to the Company's system (by attaching documents revealing your identity), or deliver by hand or through a notary public to our postal address below, which may also change from time to time, with documents identifying you and a wet signed petition.
In the application that you will make as the owner of the personal data to exercise your rights mentioned above and that contains the description of the right you intend to use; the issue you request must be clear and understandable, the issue must be related directly with you, or if you are acting on behalf of someone else, you must be specifically authorized to do so and certify this authority, and the application must contain your identity and address information.
The company concludes the claims contained in the application as soon as possible and no later than thirty days, free of charge (if there is no cost), depending on the nature of the request. However, if the transaction requires an additional cost, a fee may be charged in the tariff to be determined by the Personal Data Protection Board. If the answers to the applications exceed 10 (ten) pages, a transaction fee of $ 1.00 (one) will be charged for each page. If the answer is requested to be given in a recording medium such as a CD, flash memory, a fee will be charged according to the cost of the desired recording medium.

.The customer agrees that he/she has read, understood the Clarification Text on the Protection of Personal Data and the processing of his/her personal data for the purposes in this text and consents to the transfer of personal data to companies within the Enterprise Group located outside Turkey, as stated in the Clarification Text on the Protection of Personal Data.
